A LEGAL challenge is to be mounted to a charge brought against the only protestor in the UK to be accused of breaching last year's badger cull injunction.

Cathy Scott, aged 37, of Pepys Corner, Tile Hill, Coventry, is alleged to have run into a badger killing field in Tibberton, shouting and waving a torch on October 3 last year.

She was arrested as part of Operation Themis, the police response to the pilot badger cull which took place in parts of the Gloucestershire/ Worcestershire border to tackle bovine tuberculosis in cattle.

Scott has denied breaching the High Court injunction banning anyone from protesting within 100 metres of local homes or using torches, LED lights and camera flashes near the badger cull zone.

Last Thursday, Judge William Hart was told the defence will be submitting a legal challenge to the charge at a hearing on Thursday, May 29.

He told Scott if that hearing is successful the charge will be dismissed and she will not need to stand jury trial.

But if the challenge is unsuccessful a trial lasting up to six days, will begin on September 8.

Ms Scott, who has animal paw prints tattooed on the left side of her neck, was released on bail.
