Robbery charge dropped by court

A 19-year-old Worcestershire man has had a robbery charge against him dismissed after a witness twice failed to turn up at Worcester Crown Court.
Thomas Gurney, of Deacle Place, Evesham, denied stealing £80 in a robbery on March 24, 2012 and his trial was due to start on Thursday.
Timothy Sapwell, prosecuting, told the court the complainant could not be contacted.
He worked nights and had no fixed address but was living somewhere in Gloucestershire.
Mr Sapwell asked for an adjournment but Timothy Harrington, defending, opposed it on the grounds the case had now been “hanging over” the defendant for a long time.
The trial had previously been listed in July and the complainant had not appeared then so the prosecution had twice failed to produce its witness, he said.
Judge Daniel Pearce-Higgins refused an adjournment and no evidence was offered by the prosecution.
A formal not guilty verdict was recorded.
